The present debate on constitutional rights aims to protect the individual against the intrusive power of the state. Analysing the precarious relationship between art and money, the authors argue that constitutional rights need to be extended into the regimes of private governance. This requires four fundamental changes. (1) Constitutional rights can no longer be limited to the protection of individual actors. Instead, they need to be extended to guarantees of freedom of discourses. (2) The new experience of the twentieth century (...) is that totalizing tendencies have their origin not only in politics, but also in other fields of action, especially in technology, science, and the economy. Thus, a discursive concept of constitutional rights should be directed against any social system with totalizing tendencies. (3) Instead of concentrating on centres of economic and social power, constitutional rights in the private sphere should focus on the specific communicative medium of the expansionist social system involved. (4) This excludes the direct analogy of a ‘right’ as a quasispatial exclusion zone. More significant guarantees of discursive autonomy could be found in a ‘proceduralization’ of constitutional rights. (shrink)

This paper outlines the development and implementation of a new course in Engineering Ethics at the University of Tennessee. This is a three-semester-hour course and is jointly taught by an engineering professor and a philosophy professor. While traditional pedagogical techniques such as case studies, position papers, and classroom discussions are used, additional activities such as developing a code of ethics and student-developed scenarios are employed to encourage critical thinking. Among the topics addressed in the course are engineering as a profession (...) and its role in society; ethical successes and failures; risk, safety, and the environment; professional responsibilities; credit and intellectual property; and international concerns. Some 20 years ago Todd and colleagues proposed that rhythm perception is mediated by the conjunction of a sensory representation of the auditory input and a motor representation of the body (Todd, 1994a, 1995 ), and that a sense of motion from sound is mediated by the vestibular system (Todd, 1992a, 1993b ). These ideas were developed into a sensory-motor theory of rhythm and beat induction (Todd et al., 1999 ). A neurological substrate was proposed which might form the (...) biological basis of the theory (Todd et al., 2002 ). The theory was implemented as a computational model and a number of experiments conducted to test it. In the following time there have been several key developments. One is the demonstration that the vestibular system is primal to rhythm perception, and in related work several experiments have provided further evidence that rhythm perception is body dependent. Another is independent advances in imaging, which have revealed the brain areas associated with both vestibular processing and rhythm perception. A third is the finding that vestibular receptors contribute to auditory evoked potentials (Todd et al., 2014a, b ). These behavioral and neurobiological developments demand a theoretical overview which could provide a new synthesis over the domain of rhythm perception. In this paper we suggest four propositions as the basis for such a synthesis. (1) Rhythm perception is a form of vestibular perception; (2) Rhythm perception evokes both external and internal guidance of somatotopic representations; (3) A link from the limbic system to the internal guidance pathway mediates the “dance habit”; (4) The vestibular reward mechanism is innate. The new synthesis provides an explanation for a number of phenomena not often considered by rhythm researchers. We discuss these along with possible computational implementations and alternative models and propose a number of new directions for future research. (shrink)

Materials play an important role in the formation of the lifeworld. In a concentration camp, they often gain an unexpected existential importance. According to the context clothes, wood, food, earth change their meaning for the detainees. The kind of clothes corresponds with the type of camp and may be an indicator for the chances to survive. (...) In a concentration camp, a piece of wood can either be used to heat a room in extreme cold and contribute to the survival of a detainee or to beat and torture a prisoner. No discussion of when an individual is dead is meaningful in the absence of a definition of death. If human death is defined as the irreversible loss of the capacity for consciousness combined with the irreversible loss of the capacity to breathe spontaneously (and hence to maintain a spontaneous heart beat) the death of the brainstem will be seen to be the necessary and sufficient condition for the death of the individual. Such a definition of death is not something (...) radically new. It is merely the reformulation -- in the language of the neurophysiologist -- of much older concepts such as the 'departure of the (conscious) soul from the body' and the 'loss of the breath of life'. Evolutionary scepticism holds that the evolutionary account of the origins of the human cognitive apparatus has sceptical implications for at least some of our beliefs. A common target of evolutionary scepticism is moral realism. Scientific realism, on the other hand, is much less frequently targeted, though the idea that evolutionary theory should make us distrustful of science is by no means absent from the literature. This line of thought has received unduly little attention. I propose to remedy this by advancing (...) what I will call an evolutionary sceptical challenge to scientific realism. I argue that, given standard evolutionary theory, our possession of sound innate metaphysical intuitions would have taken an epistemically problematic ‘lucky accident’. This, as I will show, entails that scientific realism is a self-undermining position. I discuss objections to my argument’s two premises, including ones that appeal to the success of the sciences and to the possibility that sound innate metaphysical intuitions evolved as an evolutionary ‘by-product’. I then draw out an advantage of my argument over a similar one recently put forward by Graber and Golemon. I finish by submitting that scientific realism, given the soundness of my argument, is faced with a new ‘Darwinian Dilemma’, and briefly address the significance of this for the debate between realists and anti-realists in the philosophy of science. This article examines the racial politics that reshaped psychoanalytic psychotherapy and ushered in a community mental health paradigm during the U.S. Civil Rights Era. Policymakers in the 1960s adopted the language of social justice to condemn psychoanalysis for its inability to treat psychotics and its unwillingness to treat black patients; yet the community psychiatry model of treatment that replaced it compounded the denial of the black subject’s clinical needs. Challenging the extant historiography that appraises psychoanalysis as a victim of neoliberalism (...) and psychopharmacology, this paper examines how and why Freudian practitioners beat their own retreat from the specter of desegregation. Christopher Nolan’s seems a spy thriller in which a government operative saves the world. As others have noted, it is in a larger sense about climate change—even though it mentions it but once. Where the film has been dismissed as not saying anything substantial, or even read as promoting an activist message, I argue it is most coherently interpreted as a reactionary defense of the status quo. The film is about a war between the present and future, its heroes those (...) who beat back time travelers trying to prevent us from destroying the planet. If audiences are not passive recipients of propaganda, but critical and cognitive, then blockbusters need to distract them from unavowable larger meanings by redirecting interpretive energies into the details; plot holes are not a bug, but a feature. The meticulous, puzzle-box construction of Nolan’s films, which encourages elaborate fan theorizing, distracts both viewers and Nolan himself from their ideological content. (shrink)

This paper attempts an interpretation of Everett''s relative state formulation of quantum mechanics that avoids the commitment to new metaphysical entities like worlds or minds. Starting from Everett''s quantum mechanical model of an observer, it is argued that an observer''s belief to be in an eigenstate of the measurement (corresponding to the observation of a well-defined measurement outcome) is consistent with the fact that she objectively is in a superposition of such states. Subjective states corresponding to such beliefs are constructed. (...) From an analysis of these subjective states and their dynamics it is argued that Everett''s pure wave mechanics is subjectively consistent with von Neumann''s classical formulation of quantum mechanics. It follows from the argument that the objective state of a system is in principle unobservable. Nevertheless, an adequate concept of empirical reality can be constructed. (shrink)

"The overall aim of this book is to understand the character of moral progress, so that making moral progress may become more systematic and secure, less chancy and less bloody. Drawing on three historical examples - the abolition of chattel slavery, the expansion of opportunities for women, and the increasing acceptance of same-sex love - it asks how those changes were brought about, and seeks a methodology for streamlining the kinds of developments that occurred. Moral progress is conceived as pragmatic (...) progress, progress from rather than progress to, achieved by overcoming the problems and limits of the current situation. Two kinds of problems are distinguished: problems of exclusion, found when the complaints of some people are ignored; and problems of false consciousness, present when the oppressed adopt judgments from the ambient society and do not protest their condition. The proposed methodology advocates procedures for listening to voiced complaints and for systematically reviewing the way in which particular self-conceptions, ideals and identities are taken to be appropriate for various groups of people. Through outlining a picture of moral practice, at both the individual and the societal levels, the book seeks to orient moral philosophy away from metaethical questions of realism and towards moral methodology"--. The paper argues that an account of understanding should take the form of a Carnapian explication and acknowledge that understanding comes in degrees. An explication of objectual understanding is defended, which helps to make sense of the cognitive achievements and goals of science. The explication combines a necessary condition with three evaluative dimensions: An epistemic agent understands a subject matter by means of a theory only if the agent commits herself sufficiently to the theory of the subject matter, and to (...) the degree that the agent grasps the theory (i.e., is able to make use of it), the theory answers to the facts and the agent’s commitment to the theory is justified. The threshold for outright attributions of understanding is determined contextually. The explication has descriptive as well as normative facets and allows for the possibility of understanding by means of non-explanatory (e.g., purely classificatory) theories. (shrink)

Promotion of pro-social attitudes and moral behaviour is a crucial and challenging task for social orders. As traditional ways such as moral education have some, but apparently and unfortunately only limited effect, some authors have suggested employing biomedical means such as pharmaceuticals or electrical stimulation of the brain to alter individual psychologies in a more direct way — moral bioenhancement. One of the salient questions in the nascent ethical debate concerns the impact of such interventions on human freedom. Advocates argue (...) that moral bioenhancements do not pose a serious threat to freedom. This contention, however, is based on an overly narrow, if not impoverished, sense of freedom, which comprises only freedom of action and freedom of will. Mind-altering interventions primarily affect another sense of freedom: freedom of mind, a concept that has not received much attention although it should rank among the most important legal and political freedoms. The article introduces three senses of mental freedom potentially infringed upon by moral bioenhancement and places it in a broader perspective. Ignorance of mental freedom has far-ranging consequences for the shape of the political and legal order at large. As many advocates are apparently not aware of the freedoms they seek to undermine, their calls for moral enhancement programmes are dangerously premature. (shrink)

This paper explores the phenomenon of meta-emotions. Meta-emotions are emotions people have about their own emotions. We analyze the intentional structure of meta-emotions and show how psychological findings support our account. Acknowledgement of meta-emotions can elucidate a number of important issues in the philosophy of mind and, more specifically, the philosophy and psychology of emotions. Among them are (allegedly) ambivalent or paradoxical emotions, emotional communication, emotional self-regulation, privileged access failure for repressed emotions, and survivor guilt.

The paper introduces, compares and contrasts formal models of source reliability proposed in the epistemology literature, in particular the prominent models of Bovens and Hartmann and Olsson :127–143, 2011). All are Bayesian models seeking to provide normative guidance, yet they differ subtly in assumptions and resulting behavior. Models are evaluated both on conceptual grounds and through simulations, and the relationship between models is clarified. The simulations both show surprising similarities and highlight relevant differences between these models. Most importantly, however, our (...) evaluations reveal that important normative concerns arguably remain unresolved. The philosophical implications of this for testimony are discussed. (shrink)

I discuss two accounts of rational religious faith that have recently been proposed by Peter Rohs and Volker Gerhardt, respectively, and critically explore the relations between (i) faith and knowledge and (ii) faith and hope. I argue that, if faith essentially involves some form of eschatological hope, then a theory of rational faith will have to include an analysis of rational hope.

It is sometimes claimed that non-human animals (and perhaps also young children) live their lives entirely in the present and are cognitively ‘stuck in time’. Adult humans, by contrast, are said to be able to engage in ‘mental time travel’. One possible way of making sense of this distinction is in terms of the idea that animals and young children cannot engage in tensed thought, which might seem a preposterous idea in the light of certain findings in comparative and developmental (...) psychology. I try to make this idea less preposterous by looking into some of the cognitive requirements for tensed thought. In particular, I suggest that tensed thought requires a specific form of causal understanding, which animals and young children may not possess. (shrink)

Self-deception is a special kind of motivational dominance in belief-formation. We develop criteria which set paradigmatic self-deception apart from related phenomena of automanipulation such as pretense and motivational bias. In self-deception rational subjects defend or develop beliefs of high subjective importance in response to strong counterevidence. Self-deceivers make or keep these beliefs tenable by putting prima-facie rational defense-strategies to work against their established standards of rational evaluation. In paradigmatic self-deception, target-beliefs are made tenable via reorganizations of those belief-sets that relate (...) relevant data to target-beliefs. This manipulation of the evidential value of relevant data goes beyond phenomena of motivated perception of data. In self-deception belief-defense is pseudo-rational. Self-deceivers will typically apply a dual standard of evaluation that remains intransparent to the subject. The developed model of self-deception as pseudo-rational belief-defense is empirically anchored. (shrink)

According to recent social interactionist accounts in developmental psychology, a child's learning to talk about the past with others plays a key role in memory development. Most accounts of this kind are centered on the theoretical notion of autobiographical memory and assume that socio-communicative interaction with others is important, in particular, in explaining the emergence of memories that have a particular type of connection to the self. Most of these accounts also construe autobiographical memory as a species of episodic memory, (...) but its episodic character, as such, is not typically seen as falling within the remit of an explanation in social interactionist terms. I explore the idea that socio-communicative interaction centered on talk about the past might also have an important role to play, quite independently of considerations about the involvement of the self in memory, in accounting for the emergence of memories that are episodic in character, i.e., memories that involve the recollection of particular past events. In doing so, I also try to shed light on a distinctive role that talk about the past plays in socio-communicative interaction. (shrink)

(1) The aim of the paper is to develop a reduction of fallacy theory, i.e. to 'deduce' fallacy theory from a positive theory of argumentation which provides exact criteria for valid and adequate argumentation. Such reductionism has several advantages compared to an unsystematic action, which is quite usual in current fallacy but which at least in part is due to the poor state of positive argumentation theory itself. (2) After defining 'fallacy' (3) some principle ideas and (4) the exact criteria (...) for (argumentatively) valid and adequate arguments of the 'practical theory of argumentation' of the author are expounded. These criteria will be used as the positive basis for the following reduction. (5) In the main part of the paper a systematization, definition and explanation of the main types and many subforms of fallacies of argumentative validity and (6) adequacy is developed, following the list of positive conditions of validity and adequacy. In addition to many new types of fallacies, this systematization contains the most important of the traditionally known and named fallacies; these are explained and the criteria for some of them are corrected or put more precisely. Climate model projections are used to inform policy decisions and constitute a major focus of climate research. Confidence in climate projections relies on the adequacy of climate models for those projections. The question of how to argue for the adequacy of models for climate projections has not gotten sufficient attention in the climate modelling community. The most common way to evaluate a climate model is to assess in a quantitative way degrees of “model fit”; i.e., how well model results fit (...) observation-based data (empirical accuracy) and agree with other models or model versions (robustness). However, such assessments are largely silent about what those degrees of fit imply for a model’s adequacy for projecting future climate. We provide a conceptual framework for discussing the evaluation of the adequacy of models for climate projections. Drawing on literature from philosophy of science and climate science, we discuss the potential and limits of inferences from model fit. We suggest that support of a model by background knowledge is an additional consideration that can be appealed to in arguments for a model’s adequacy for long-term projections, and that this should explicitly be spelled out. Empirical accuracy, robustness and support by background knowledge neither individually nor collectively constitute sufficient conditions in a strict sense for a model’s adequacy for long-term projections. However, they provide reasons that can be strengthened by additional information and thus contribute to a complex non-deductive argument for the adequacy of a climate model or a family of models for long-term climate projections. _Nietzsche: Naturalism and Interpretation_ offers a resolution of one of the most vexing problems in Nietzsche scholarship. As perhaps the most significant predecessor of more recent attempts to formulate a postmetaphysical epistemology and ontology, Nietzsche is considered by many critics to share this problem with his successors: How can an antifoundationalist philosophy avoid vicious relativism and legitimate its claim to provide a platform for the critique of arguments, practices, and institutions? Christoph Cox argues that Nietzsche successfully navigates between relativism (...) and dogmatism, accepting the naturalistic critique of metaphysics and theology provided by modern science, yet maintaining that a thoroughgoing naturalism must move beyond scientific reductionism. It must accept a central feature of aesthetic understanding: acknowledgment of the primacy and irreducibility of interpretation. This view of Nietzsche's doctrines of perspectivism, becoming, and will to power as products of an overall naturalism balanced by a reciprocal commitment to interpretationism will spur new discussions of epistemology and ontology in contemporary thought. In this paper, I investigate in detail one theoretical approach to the symptom of thought insertion. This approach suggests that patients are lead to disown certain thoughts they are subjected to because they lack a sense of active participation in the occurrence of those thoughts. I examine one reading of this claim, according to which the patients’ anomalous experiences arise from a breakdown of cognitive mechanisms tracking the production of occurrent thoughts, before sketching an alternative reading, according to which their (...) experiences have to be explained in terms of a withdrawal, on the part of the patients themselves, from certain forms of active engagement in reasoning. I conclude with a discussion of the relationship between this view and the idea that patients’ reports of thought insertion reflect a situation in which the boundaries between the self and the world have become uncertain. The question of whether cognition can influence perception has a long history in neuroscience and philosophy. Here, we outline a novel approach to this issue, arguing that it should be viewed within the framework of top-down information-processing. This approach leads to a reversal of the standard explanatory order of the cognitive penetration debate: we suggest studying top-down processing at various levels without preconceptions of perception or cognition. Once a clear picture has emerged about which processes have influences on those at (...) lower levels, we can re-address the extent to which they should be considered perceptual or cognitive. Using top-down processing within the visual system as a model for higher-level influences, we argue that the current evidence indicates clear constraints on top-down influences at all stages of information processing; it does, however, not support the notion of a boundary between specific types of information-processing as proposed by the cognitive impenetrability hypothesis. Pascal‘s wager is expounded as a paradigm case of a practical,decision-theoretical argument for acting as if a proposition is true when wehave no theoretical reasons to accept or reject it (1.1.–1.2.). Thoughthe paradigm is fallacious in various respects there are valid and adequatearguments for acting as if certain propositions are true: that theoreticalentities exist, that there are material perceptual objects, that the worldis uniform across time (1.3). After this analysis of examples the author‘sgeneral approach for developing criteria for the validity (...) and adequacy oftypes of argument (2.1.) is applied: Having discussed some problems(2.2.–2.3.), a general epistemic principle for such ’pascal arguments‘is developed, which characterizes their premisses and, if introduced as anadditional premiss, can make them deductively valid (2.4). In the Critique of Judgment, Kant quotes the traditional view of the relation between the ethical and the aesthetical ('the beautiful is the symbol of the morally good'). However, he elaborates this view in a radically new way: as equivalence between two forms of reflection, between ethical and aesthetic reflection. The article distinguishes three different aspects of aesthetic reflection in Kant and discusses their respective ethical meaning. It shows the unresolved tension between Kant's program of an 'aesthetics of autonomy' on (...) the one hand, and his reference to sensualistic and vitalist motifs of an aesthetic 'energetism' on the other.
